Bidder Registration Requirements and Legal Disclaimer
This is NOT an absolute auction; Seller, at its option, has final right to accept or reject any bid. Sale is AS IS WHERE IS, free and clear of all known liens, mortgages and encumbrances. All information pertaining to the vessel’s equipment or condition is believed to be accurate but is not guaranteed. Bidders assume responsibility to verify any and all information and specifications provided. Again, sale is AS IS WHERE. Seller and G. Robert Toney & Ass. d/b/a/ National Liquidators, it agents and employees, make no warranties or representations, express of implied, as to the condition of the vessel or its fitness for a particular purpose. All necessary documentation needed to transfer title shall be provided to Buyer within 15 days of closing. ALL bidders must deposit $100,000 USD certified funds into National Liquidators’ Escrow Account no later than 3:00 pm November 16th, 2009. NO CASH, NO PERSONAL CHECKS, NO CREDIT CARDS will be accepted for any deposit or final payment. All deposits of non-winning bids will be returned via outgoing wire transfer 3 business days after the close of the sale. Winning bidders will have their deposit of $100,000 applied toward the final sale price. 100% of the balance of winning bid must be received into National Liquidators Escrow Account no later than 4:00 pm ET Monday, November the 23rd, 2009. Failure to pay the balance of the winning bid as set forth herein will result in forfeiture of the deposit and the vessel will be made available for sale to other parties. The sale shall comply with all laws of the US including the citizenship requirements of Section 2 of the Shipping Act of 1916 as amended. Buyer is responsible for any sales tax due on the transaction. Buyer must either pay sales tax at the time of closing or execute an Affidavit for Exemption of Boat Sold for Removal from the State of Florida by a Non-Resident Purchaser and comply with the requirements therein.
